Terms of Service
1. Agreement
These Terms are a contract between you and Myrieon LLC, a Texas limited liability company ("Myrieon", "we", "us"). By creating an account or using the service you accept them. We record the version you accepted and when.
2. The service
Myrieon provides containerised game server hosting on infrastructure we operate. You choose the memory, CPU and disk your server receives and pay for that allocation.
We do not oversubscribe memory. Every server reserves its full memory allocation for as long as it runs. CPU is shared and may be throttled under contention; memory is not.
You receive full SFTP access to your server's files from the first minute. Your data is yours and you may remove it at any time.
3. Eligibility
You must be at least 16 years old to hold an account. This is a single global minimum and there is no exception for parental consent.
If we learn an account holder is under 16 we will close the account and delete the associated personal data. If you believe someone under 16 holds an account, contact legal@myrieon.com.
You must be the cardholder for the payment method on the account, or have the cardholder's authorisation to use it.
4. Your account
You are responsible for activity under your account and for keeping your credentials secure. Share access through the subuser system rather than by sharing credentials — actions taken through a shared login are attributed to you, and doing so is a breach of the Acceptable Use Policy.
Notify security@myrieon.com promptly if you believe your account is compromised.
5. Payment, renewal and tax
Service is billed monthly in advance and renews automatically until cancelled, at the then-current price for your configuration. Price changes are notified at least 30 days ahead and take effect at your next renewal.
Texas sales tax is added at checkout where applicable and is not included in displayed prices.
Failure to pay may result in suspension. Suspended servers are retained for 30 days and then deleted.
6. Refunds
- First purchase: full refund within 72 hours, no questions asked.
- Deleting a server stops it immediately and credits the unused part of the month to your account. Cancelling instead keeps it running to the end of the paid month, with no credit.
- Account credit is applied automatically to future invoices and is not otherwise paid out in cash, except that credit from deleted or downsized servers is refunded on request within 30 days of closing your account.
- No refund where the account was terminated for breach of the Acceptable Use Policy, or where a chargeback has been initiated.
The full Refund Policy explains how to request one.
7. Service levels
The Service Level Agreement forms part of these Terms. We do not offer any uptime guarantee beyond it, and the remedy for a miss is service credit, not cash.
8. Suspension and termination
We may suspend or terminate an account for breach of these Terms or the Acceptable Use Policy. Where practical we warn first; for illegal activity, a payment dispute, or conduct that degrades service for other customers, action is immediate.
You may cancel at any time. See §9 for what happens to your data.
9. Your data when you leave
Three options, each doing something different:
| Option | Effect |
|---|---|
| Close account | Access ends. Game data is retained for 30 days and can be restored in that window, then deleted. |
| Delete my account and data | Account closes immediately. Personal data is erased except what we are legally required to keep — see the Privacy Policy. Irreversible, and we will no longer be able to identify you for support or payment disputes. |
| Clear my activity data | Account stays open. Stored payment methods and activity history are purged. This is not erasure. |
Records we must retain — financial records, the file audit log, and anything under a legal preservation hold — survive all three. The Privacy Policy sets out periods and reasons.
10. Content and conduct
You are responsible for everything on your server. We do not monitor customer files routinely, but we log file operations (see the Privacy Policy) and we act on reports and legal process.
We respond to valid DMCA notices under our DMCA Policy. We report apparent child sexual abuse material to NCMEC as US law requires.
11. Intellectual property and third parties
Myrieon is not affiliated with, endorsed by, or sponsored by any game publisher, including Mojang, Microsoft, Valve, or any mod platform. Game software is downloaded at install time from the publisher's own distribution, into your volume. Where a game requires a licence you own, you supply your own credentials.
You retain all rights in your own content.
12. Warranties
The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We are a small operation. We say so openly. We do not promise enterprise redundancy we do not have.
13. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the three months preceding the claim.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, or data — including loss of game world data. Keep your own backups of anything you cannot replace.
14. Indemnification
You will indemnify and hold harmless Myrieon LLC and its members against claims, damages and reasonable legal costs arising from your use of the service, your content, or your breach of these Terms.
15. Dispute resolution — arbitration and class waiver
Please read this section carefully. It affects how disputes are resolved.
Any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered under the rules of a recognised arbitration provider, seated in Walker County, Texas, rather than in court.
You and Myrieon each waive any right to a jury trial and to participate in a class, collective, or representative action.
Either party may bring an individual claim in small claims court instead. This section does not prevent either party from seeking injunctive relief for infringement or misuse of intellectual property.
16. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Where arbitration does not apply, venue lies exclusively in the state and federal courts of Walker County, Texas.
17. Changes
We may modify these Terms. Material changes are notified by email and on the site at least 30 days before taking effect. Continuing to use the service after that constitutes acceptance. Prior versions are archived and available on request.
